General Terms and Conditions of Business (GTC) of Les Couleurs Suisse AG
1. Scope of application
These GTC of Les Couleurs Suisse AG, Schwamendingenstrasse 10, 8050 Zürich, Switzerland, apply exclusively to all deliveries and services offered through the internet shop www.shop.lescouleurs.ch. These GTC are deemed to have been accepted when the order is sent. Les Couleurs Suisse AG reserves the right to change the GTC at any time. Different or additional conditions only apply if this has been explicitly agreed in writing. 2. Delivery areaLes Couleurs Suisse AG delivers its products worldwide. Seminars are held around the headquarters of Les Couleurs Suisse AG. 3. Delivery periodDelivery periods depend on the postal services in the country to which an order has to be sent. Les Couleurs Suisse AG cannot therefore guarantee any fixed delivery periods. Deliveries to Germany, Austria and within Switzerland are usually made within seven to ten working days. Deliveries to countries outside Europe are usually made within 14 working days. These delivery periods are simply a yardstick and delivery may take longer in special situations. 4. Minimum order valueThere is no general minimum order value. Exceptions may apply to promotion vouchers. The details are provided on the relevant vouchers (cf. section 8). 5. Pricesa) Delivery within Switzerland: the prices in the check-out process are given in Swiss francs (CHF) and include the statutory VAT. The shipping and handling charges shall also be borne by the customer. b) Delivery abroad: all prices are given in Swiss francs (CHF) and do not include the statutory VAT. The shipping and handling charges shall also be borne by the customer. Prices do not include any fees and taxes that may be payable outside Switzerland, which have to be paid by the customer. 6. Handling and shipping costsThe Swiss postal service handles the dispatch of all orders. The handling and shipping costs are based on the weight and size of the ordered goods, as well as the delivery address provided by the customer, and are automatically calculated by our shop system. The shipping and handling charges shall be borne by the customer. These costs are displayed in the shopping cart before an order is sent. The customer also bears any additional costs incurred for special delivery requests. 7. Terms of paymentPayment is made according to one of the payment options available during the order process (PayPal, invoice) on the stated terms. All invoices are payable net within 14 days of the invoice date. For customers who fail to pay their invoices, CHF 30.00 (excluding VAT) is charged per reminder, plus any additional collection costs. Les Couleurs Suisse AG reserves the right to request advance payments.
8. Redemption of promotion vouchers
Promotion vouchers are vouchers with a restricted period of validity that are distributed by Les Couleurs Suisse AG at promotional events. These vouchers cannot be purchased. The following conditions as well as the conditions printed on the vouchers apply to these promotion vouchers. Promotion vouchers are only valid for the period indicated. They can only be redeemed once and only before the end of an order process. Promotion vouchers cannot be combined with one another (or with different promotion vouchers). Some products may be excluded from the voucher campaign. The required minimum order value is stated on the voucher. If the minimum order value is subsequently not met because some articles are returned, Les Couleurs Suisse AG reserves the right to cancel the voucher and invoice the products delivered to the customer. If the value of a promotion voucher does not cover the value of the order, the difference must be paid using one of the available payment options (see section 7). Owners of vouchers are not entitled to the reimbursement or replacement of a voucher. The value of the voucher shall neither be paid out in cash, nor shall it earn interest.
9. Withdrawal Instructions
Withdrawal right
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. of your decision to withdraw from this contract by an unequivocal statement, via e-mail. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us at the above address, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
10. Liability
To the extent permitted by law, Les Couleurs Suisse AG excludes all liability. It excludes in particular any liability for deviations between the colours of the products displayed in the internet shop and the actual colours of the products. Customers who resell the products are responsible for complying with Swiss and foreign export regulations. If the customer changes the products that are resold, the customer is liable for any resulting damage suffered by the buyer or third party.
11. Online Dispute Resolution
The European Commission has provided a platform for online dispute resolution, which can be found at the following link: http://ec.europa.eu/consumers/odr/. We are legally obliged to provide this information. However, we do not participate in this type of dispute resolution.
12. Reservation of ownership
The goods remain the property of Les Couleurs Suisse AG until they have been paid for in full.
13. Data protection
Les Couleurs Suisse AG complies with the " Regulation of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data" (GDPR) when collecting and processing personal data. The GDPR came into force on 25 May 2018. The data required for processing the business transaction is collected in our online shop. This data is protected by suitable technical measures and is treated confidentially.
The privacy policy (https://www.lescouleurs.ch/en/about-us/privacy-policy/) applying to the website (http://www.lescouleurs.ch) and for the online shop (http://shop.lescouleurs.ch/) forms part of these GTC. Les Couleurs Suisse AG only uses personal data in compliance with this privacy policy. The customer herewith acknowledges that using this website also means that Les Couleurs Suisse AG may use the personal data provided by the customer. By using this website, the customer also approves the privacy policy. Detailed information can be found in the privacy policy.
14. Protection of intellectual property
The contents of the website are protected by copyright. Modifications, reproductions and imitations of any kind are prohibited and may be prosecuted under civil and/or criminal law.

16. Place of performance and jurisdiction
The place of jurisdiction is Zurich. These GTC are governed exclusively by Swiss law, even if orders are placed from or delivered to a foreign country. The parties shall make every endeavour to settle amicably any disputes that may arise from the performance of this contract.
